Nike Was Sued For 1987 Commercial That Used The Beatles “Revolution” Without Apple Records Permission

Nike was sued for this 1987 commercial that used The Beatles song “Revolution” against the wishes of Apple Records.  Nike paid $250,000 total to Capitol Records which held the North American licensing rights to The Beatles’ recordings and $250,000 to Michael Jackson who had acquired The Beatles publishing rights in 1985.  Nike had the right to use the “Revolution” for a year.

The three surviving Beatles, through their record company Apple, filed a lawsuit in July 1987 for $15 million objecting to Nike’s use of the song.  The suit was aimed at Nike, its advertisement agency, Wieden+Kennedy, and Capitol-EMI Records.  George Harrison said that “every Beatles song ever recorded is going to be advertising women’s underwear and sausages.  We’ve got to put a stop to it in order to set a precedent. Otherwise it’s going to be a free-for-all. It’s one thing when you’re dead, but we’re still around!  They don’t have any respect for the fact that we wrote and recorded those songs, and it was our lives.”

The suit, filed in State Supreme Court in Manhattan, charges that the shoe company, Nike Inc., ”wrongfully traded on the good will and popularity of the Beatles,” by using the John Lennon-Paul McCartney song, ”Revolution,” in its advertising.  Capitol-EMI countered by saying the lawsuit was ‘groundless’ because Capitol had licensed the use of “Revolution” with the “active support and encouragement of Yoko Ono Lennon, a shareholder and director of Apple.”  Ono had expressed approval when the commercial was released, saying the commercial “is making John’s music accessible to a new generation”.

On November 9, 1989, the “Revolution” lawsuit and others involving the Beatles and EMI were settled out-of-court.  One condition of the out-of-court settlement was that terms of the agreement would be kept secret. The settlement was reached among the three parties involved: George Harrison, Paul McCartney, Ringo Starr; Yoko Ono; and Apple, EMI and Capitol Records.  A spokesman for Yoko Ono noted, “It’s such a confusing myriad of issues that even people who have been close to the principals have a difficult time grasping it. Attorneys on both sides of the Atlantic have probably put their children through college on this.”

Nike discontinued airing ads featuring “Revolution” in March 1988.  In 1993 Yoko Ono later gave permission to Nike to use John Lennon’s Instant Karma” in this ad below.

Info About The Beatles Magical Mystery Tour Bus

Here are some details on the Magical Mystery Tour bus used by The Beatles to film the Magical Mystery Tour movie, which launched the soundtrack that topped both the British and American charts.  The bus is a Plaxton bodied 1959 Bedford Val Panorama Elite bus license plate URO 913E.  This bus was new to coach company Fox of Hayes, in 1967.

The Hard Rock Cafe acquired the Magical Mystery Tour bus in 1988. It took four months, 2,000 man-hours and a cost of $100,000 for Hard Rock to completely refurbish the bus using vintage parts to replicate the original designs and details.  Here’s a photo below of the bus being transported.

The Hard Rock Cafe offered the bus years ago as a prize in an Internet sweepstakes but apparently the winner chose the cash alternative so the bus remains with Hard Rock Cafe as Beatles memorabilia.

Jimi Hendrix Covered “Sgt. Pepper” Days After It’s Release In Front Of The Beatles

On June 4, 1967, Jimi Hendrix and the Experience played their last show in England, at London’s Saville Theatre, before heading off to America.  The Beatles’ Sgt. Pepper album had just been released on June 1 and The Beatles were in attendance.  Hendrix, who was already a great fan of the band, bought the album on the day of its release and covered it the opening track two days later.

Hendrix chose to open the show with his own rendition of “Sgt. Pepper’s Lonely Hearts Club Band“, rehearsed only minutes before taking the stage, much to The Beatles astonishment and delight.  Hendrix didn’t know at the time that they were in the audience. Paul McCartney said later he was honored by the tribute; “simply incredible, perhaps the best I have ever seen him play.”

The Beatles Sgt. Peppers Lonely Hearts Club Band Alternate Drum Skin

Joe Ephgrave is a visual artist who designed The Beatles’ drum skin placed at the center of the Sgt. Pepper’s Lonely Hearts Club Band album cover.  The drum was sold for 541,250 GBP (1.07M USD), at auction on July 10, 2008 and was thought to be acquired by Paul McCartney himself.

Ephgrave actually designed two logos for the drum skins….below is the lesser known “alternate head”, the original of which is also owned by Paul McCartney and hangs in his London home.  The Beatles chose what became the well-known Pepper logo drum head that appears on the album cover, only one studio image was taken that day with the drum turned around showing the alternate side.

There has been some speculation that Joe Ephgrave does not exist.  It is believed that his name ‘Ephgrave’ is a shortened version of ‘Epitaph-grave’, another element hinting toward the whole ‘Paul is dead’ scandal. However, Ephgrave is a real English surname, which has been around for over 500 years, allegedly.

The Rolling Stones Returned The Sgt. Pepper Album Cover Tribute To The Beatles

At the edge of the cover on The Beatles, “Sgt. Pepper’s Lonely Hearts Club Band” album cover there is a Shirley Temple doll wearing a sweater in homage to The Rolling StonesTemple’s sweater say “Welcome The Rolling Stones“.  The Stones returned the tribute by having The Beatles hidden in the cover of their own “Their Satanic Majesties Request” album later that year.  “Their Satanic Majesties Request” had a lenticular 3-D cover.

George Harrison Died At Paul McCartney’s House That He Bought From Courtney Love

When George Harrison passed away on Nov. 29, 2001 the death certificate said the former Beatle had died at 1971 Coldwater Canyon Road in Beverly Hills.  The only problem: There is no 1971 Coldwater Canyon Road there. After an investigation, the L.A. District Attorney’s office has determined that the death actually occurred at 9536 Heather Road, a Los Angeles house once rented and now owned by Paul McCartney.

According to public records, Courtney Love sold her house in Beverly Hills to McCartney in 2001.  Love put the home on the market at about the same time McCartney was in town looking for a new place, according to local brokers. The four-bedroom, French-style home built in the late 1930s closed for $3.995 million. (Love bought the home from comedienne Ellen DeGeneres in 1997 for about $3 million.) The home’s main selling point for celebrities is the privacy it offers: The one-and-a-half-acre property is gated and surrounded by stone walls and tall trees. It also has a private pool.

(The certificate has since been amended.) Gavin de Becker, whose firm provided the erroneous address, calls the probe “a big waste of money and time.” Civil rights attorney Gloria Allred, who filed the complaint that spurred the investigation, disagrees: “No one has the right to falsify public records. There is no celebrity exception in the law.”

Adolf Hitler Did Not Make The Cut On The Beatles Sgt. Pepper Album Cover

The cover of The Beatles album “Sgt. Pepper’s Lonely Hearts Club Band” featured a colourful collage of life-sized cardboard models of famous people on the front of the album.  The Beatles chose some of their favorite hero’s.  Most of the suggestions for names to be included came from Paul McCartney, John Lennon and George Harrison, Ringo Starr demurred and let the others choose.  Harrison opted for a number of Indian gurus to reflect his spiritual leanings while Lennon’s list, thought to be half-joking, included Jesus, Hitler and Gandhi.

Sir Peter Blake who designed the set said “Hitler and Jesus were the controversial ones, and after what John said about Jesus we decided not to go ahead with him - but we did make up the image of Hitler. If you look at photographs of the out-takes, you can see the Hitler image in the studio. With the crowd behind there was an element of chance about who you can and cannot see, and we weren’t quite sure who would be covered in the final shot. Hitler was in fact covered up behind the band.”
